Anyone facing the trauma of imminent foreclosure would be well advised to steer clear of this disorganized, confusing, and misguided book. While there is some useful information on refinancing, loan extensions, and bankruptcy, the author’s explanations of civil procedure and trial tactics are unlikely to be easily understood by laypersons. Most serious, however, is Malone’s astonishing argument that mortgage loans should be challenged on Constitutional grounds, based on the fact that the borrower receives credit, not “Constitutional money”and is therefore a victim of fraud and usury. The suggestion that long-term possession of a home, combined with growing equity and tax benefits, represents nothing of value is unlikely to be accepted in court, and if it were taken seriously would virtually destroy the American system of home ownership.
